A federal judge has dismissed the criminal case against former FBI Director James Comey, ruling that the prosecution was built on an improper legal foundation rather than on the strength of evidence. The decision, issued by U.S. District Judge Cameron McGowan Currie, abruptly ended one of the most politically charged cases in recent years and raised fresh concerns about how the Justice Department handled the matter.

The case collapsed because the lead prosecutor, Lindsey Halligan, was found to have been appointed illegally. Halligan had been serving as interim U.S. Attorney for the Eastern District of Virginia, but her appointment exceeded federal limits and did not follow the legal process required for such a role. Judge Currie ruled that since Halligan lacked lawful authority, the charges she brought against Comey were invalid.

The same legal flaw affected another high-profile case she led, the prosecution of New York Attorney General Letitia James. That case was also dismissed, creating a ripple effect within the Justice Department and prompting widespread criticism of the appointment process used in both investigations.

Judge Currie emphasized that her decision had nothing to do with Comey’s alleged actions. Instead, she made clear that the government must follow the law when selecting prosecutors, especially in politically sensitive cases. By failing to do so, the Justice Department compromised the integrity of the proceedings.

The dismissal was issued “without prejudice,” meaning prosecutors could file new charges. However, legal experts note that the statute of limitations likely expired on most of the alleged offenses, making a new prosecution unlikely. For Comey and James, the ruling effectively ends their legal battles. For the Justice Department, it serves as a sharp reminder that political pressure cannot override federal law or constitutional limits.

The judge’s ruling quickly fueled debate across Washington. Supporters of Comey viewed it as a sign that the case was flawed from the start, while critics accused the Justice Department of mishandling a prosecution that was already under heavy national scrutiny.

As the Justice Department reviews its next steps, the ruling leaves behind an important message: even in the highest-profile cases, proper legal process is not optional; it is essential.
